Following a full recall of both the ASR Hip Resurfacing System and the ASR XL Acetabular System, hundreds of the recipients of these defective hip implant devices have filed lawsuits against the makers of these devices, DePuy Orthopaedics. Owned by Johnson & Johnson since 1998, DePuy designs as well as markets various products for the repair and rebuilding damaged joints. FDA DePuy Hip Implant Warning
In August of 2010, the United States Food and Drug administration sent a warning letter to Johnson & Johnson owned Depuy Orthopaedics regarding its illegal marketing of its Corail Hip System. According to the letter, Depuy’s marketing of this hip implant device was done without the necessary marketing clearance or endorsement and was thus in infringement of the Federal Food, Drug, and Cosmetic act. This legislation, passed in 1983, gives the FDA the authority to supervise the safety of food, drugs, and cosmetics. The FDA Warning letter stated that DePuy made certain claims about its Corail Hip System that were not in accordance with the premarketing approval. As a result, the FDA demanded that DePuy immediately stop marketing the hip implant for these unapproved treatments and uses.

Upon receiving the FDA warning letter, DePuy recalled two other hip replacement products: the ASR XL Acetabular System and the ASR Hip Resurfacing System. These hip implants were recalled due to the fact that these devices demonstrated significantly higher rates of replacement after the initial operation. According to the data, 1/8 of patients using these Depuy hip implants needed additional surgery due to an improper fit of the device. In 2004, Wright Medical Technology was forced to recall its CONSERVE metal hip cups due to improper manufacturing. Now, there is speculation that its Profemur hip implant system will also be subject to a recall. The Wright Profemur Total Hip System underwent the expedited approval protocol 510(K) by the United States Food and Drug Administration.
